The appellate court sitting in Abuja has upheld Mr Ademola Adeleke as the governor of Osun State.
Recall that the Osun State tribunal had sacked Adeleke as Governor months after his victory citing such issues as over-voting in 749 polling units in the 10 LG areas of the state.
A three-member panel of justices decided in Adeleke’s appeal on Friday, concluding that the election tribunal fell short in finding that Gboyega Oyetola and the All Progressives Congress had established their claim of over voting.
The court of appeal had faulted the tribunal for making a decision which was based on oral witness of alleged over voting as what is usually considered are the information on the BVAs and voter registration.
In addition to overturning the tribunal’s decision, the court gave the All Progressive Congress, APC, and its candidate Gboyega Oyetola N500, 000 in costs in its lead judgment, which was delivered by Justice Mohammed Lawal.
