The Supreme Court on Thursday postponed an appeal filed by Sen Smart Adeyemi against the judgments of the lower courts on the Kogi All Progressives Congress (APC) Governorship primary election, to October 23, 2023, for judgment.
Adeyemi had filed a lawsuit at the Federal High Court asking for the annulment of the APC primary election that resulted in Usman Ododo serving as the party’s flagbearer for the state’s governorship election scheduled for November 11. The High Court as well as the Court of Appeal both dismissed the case for lack of merit.
The Supreme Court informed the man’s attorney, Musibau Adetumbi, SAN, that his client had failed to object to concurrent findings made by the High Court and the Court of Appeal, both of which had ruled that primary elections had taken place in Kogi State.
However, the appellant’s attorney declared that he would proceed with the appeal.
Thus, for a final decision on the appeal, Justice Inyang Okoro postponed it until October 23, 2023.
SAN Abdulwahab Mohammed represented the All Progressives Congress, Chief Anthony Adeniyi, the Independent National Electoral Commission, and Mr. Usman Ododo, the APC governorship candidate was represented by Abdullahi, SAN.
Adekunle Oladapo Otitoju had argued the Senator Adeyemi’s appeal, which was completely devoid of any merit, before the Court of Appeal on August 18, 2023.
Adeyemi was found to have utterly failed to prove all serious criminal claims made against the APC and its leaders regarding the handling of the primary election, according to a unanimous decision by a three-judge panel of the Court.
