On Monday, the Supreme Court dismissed the Allied People’s Movement’s appeal against Rivers State Governor Siminalayi Fubara’s victory.
In the appeal filed by the All Progressives Congress and its candidate, Patrick Tonye-Cole, the five-member panel of the supreme court, presided over by Justice Kudirat Kekere-Ekun, likewise deferred in rendering a decision.
During Monday’s sessions, the APM’s attorney and its candidate for the March 18 election, Innocent Kere, decided to withdraw the appeal.
Later, the supreme court dismissed the appeal.
Following the court’s consideration of the parties’ arguments, the Tonye-Cole and APC appeal was set aside for decision.
In addition to other petitioners, Tonye-Cole claims that Fubara did not step down from his position as the state’s accountant general by the date set by the Electoral Act and the constitution.
All of Fubara’s appeals had been rejected by lower courts, which had also confirmed his election.
