On Friday, the Supreme Court rejected the All Progressive Congress’ (APC) request to overturn Governor Peter Mbah of Enugu State’s election victory.
The appeal that the APC and its candidate in the state, Uche Nnaji, filed to contest the declaration of Mbah of the Peoples Democratic Party (PDP) as the election’s victor was dismissed as incompetent by a five-member panel of justices in a unanimous decision.
Nnaji and the APC submitted an invalid brief of argument, the Supreme Court ruled, according to Justice Tijani Abubakar.
According to the ruling, the appellants failed to provide any convincing arguments as to why the Governor Mbah’s election victory should be thrown out as a result of the invalid process they filed.
According to the court, the substantive appeal was ultimately impacted because the appellant’s argument brief had a legal flaw.
As a result, it found the appellants incompetent and dismissed their case.
Remember that Nnaji’s case against Mbah was also dismissed by the Enugu Court of Appeal on July 18?
In addition, the appellate court fined Nnaji and the APC N250,000 each.
At the conclusion of the governor’s race in Enugu State, the Independent National Electoral Commission (INEC) announced that Mbah had received 160,895 votes, defeating Chijioke Edeoga of the Labour Party (LP), who received 157,552 votes.
However, Frank Nweke Jr. Nnaji, of the All Progressives Grand Alliance (APGA), came in fourth place with 14,575 votes after placing third with 17,983 votes.
Nnaji petitioned to overturn Mbah’s victory because she was unhappy with the election’s results.
He claimed that Mbah presented a fake certificate to INEC to support his eligibility, insisting that Mbah was ineligible to run at the time of the election.
