Umahi’s stay of lawsuit execution striped out by court

Justice Inyang Ekwo of the Abuja Division of the Federal High Court struck out sacked Governor David Umahi’s motion, seeking a stay of execution of the March 8 judgment.

This was after Chukwuma Ume, counsel for the Ebonyi governor and his Deputy Governor Kelechi Igwe, informed the court of his intention to withdraw motions for stay of execution because an appeal had been entered at the Court of Appeal on the matter.

Counsel for the PDP, Emmanuel Ukala, did not oppose the application.

In a short ruling, Mr Ekwo struck out the matter.

The motion for stay of execution was marked: FHC/ABJ/CS/920/21, between PDP Vs. INEC and three others.

Mr Ekwo had, on March 8, in a judgment, ordered Messrs Umahi, Igwe, and 16 lawmakers to vacate their offices, following their defection from the PDP to All Progressives Congress (APC).

The governor and others sought an order of the court on March 10, staying the execution of its judgment.

Mr Ume approached the court Last Wednesday, to withdraw the stay of execution motion filed on Mr Umahi’s behalf due to a mistake in the application.
